Hi, is anyone getting any questions and/or feedback from the ruling that took place on August 19th regarding nurses now being able to be sued for following doctors' orders when they cause harm to a patient? How are you addressing with your teams? Is the NCONL planning to compose a position statement about this?

Hi Dana,

The NCBON has received calls related to this case. It is not within the authority of the NCBON to provide legal opinions on the outcomes of cases addressed through the court system. The NCBON investigates complaints received, using a Just Culture approach, and determines appropriate regulatory action based on the facts of the case. The recent NC Supreme Court ruling does not have any bearing on how the NCBON will continue to carry out its duties, which are authorized by statute in the Nursing Practice Act.
